1.Scope of these Terms & conditions
The Atelier M Living website (the “Site”) is owned and operated by Atelier M Living, Grobbendonkseweg 25 in Nijlen (Belgium). Except as otherwise noted herein, the Site is governed by these terms and conditions (“the Terms”). Please read these Terms carefully, because your use of the Site constitutes your agreement to follow and be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site. Atelier M Living reserves the right to make changes to the Site and to these Terms at any time. No material from the Site may be copied, republished, distributed, uploaded, posted or transmitted in any way, except as specifically permitted on the Site. The Site, including all of its information and contents, is Atelier M Living property or that of our suppliers or licensors. The use of the information on this Site is free as long as you do not copy, distribute or otherwise use or misuse this information. You may only re-use the information on this Site in accordance with the rules of mandatory law.
These Terms govern all contracts, supplies and other services agreed between you as the customer and Atelier M Living. Unless Atelier M Living has indicated otherwise in writing, your own general terms and conditions shall not be accepted.
The Site may be used only for lawful purposes and is available only for your personal, non-commercial use. Such use shall be limited to viewing the Site, purchasing products, providing information to the Site, and downloading product information for your personal review. You are responsible for your own communications, including the transmission, posting, and uploading of information and are responsible for the consequences of such communications to the Site.
2. Contracting between Atelier M Living and its customers
Atelier M Living shall confirm your order by email. A contract is created only when payment has been successfully made. Atelier M Living is entitled to refuse, or impose special conditions upon a supply, subject to giving reasons. If Atelier M Living is unable to clearly establish your permanent or temporary address, an order cannot be accepted.
Order processes that for whatever reason have been technically or otherwise disrupted before the payment instructions have been completed are incomplete, even if you have received an order confirmation. Such an order will in principle therefore not be delivered. Atelier M Living shall endeavor, however, to contact you to complete the payment instructions so that delivery can be made.
3. Prices
The contract price is the current price at the moment when an order is placed on the Site. VAT is included in this price. The prices quoted on the Site are exclusive of delivery costs.
For the prices that are on our Site, we strive to display the reality and the intended prices as carefully as possible. Errors that arise and are recognizable as programming or typing errors, never form a reason to be able to claim or assume a contract or agreement with Atelier M Living.
Atelier M Living strives for the most up-to-date Site possible. If, despite these efforts, the information or content on this Site is incomplete and/or incorrect, we cannot accept liability for this.
The information and/or products on this Site are offered without any form of guarantee and/or claim to correctness. We reserve the right to change, remove or re-install these materials without prior notice. Atelier M Living does not accept liability for any information that is on our Site (also to which we refer via hyperlinks).
4. Payments
All payments on the website are made through the listed electronic payment system. If you prefer to pay by bank transfer, you can contact us via info@ateliermliving.be.
5. Products on our Site
Atelier M Living updates the Site as often as possible, however all articles are sold on a first come, first served basis and it is possible for something to be sold and not indicated as so.
All of our articles are provided with an adequate description and photographs to enable you to have good judgment regarding these articles. The photographs serve as an example, the delivered articles can differ in color and condition from the articles as shown on the Site.
6. Handling of orders
Atelier M Living shall act with the greatest possible care in processing orders for articles.
Articles shall be delivered to the address given by you to Atelier M Living.
Atelier M Living shall dispatch accepted orders as quickly as possible in the order in which they are received. There is no right to compensation if actual delivery takes longer.
7. Right to return articles
Atelier M Living strives for 100% satisfaction of its customers. If one or more articles are not to your satisfaction after receiving them, you hold the right to notify us within 14 days and send them back to us. If you do not notify us within the aforementioned time frame, the items are considered sold. To be eligible for a return, your items must be unused and in the same condition that you received them. It must also be in the original packaging. Expenses incurred for sending the articles back to us and custody is at your own expense. Please ensure the articles you return are handled with due care. We are not responsible for any damages that happen during the return shipment or for the loss of your item during shipment. Damaged items will not be accepted. Once we receive your return, all goods will be inspected. Once the item has been accepted, the purchase price of the items will be refunded within 10 working days. Purchase price means the purchase amount of the item minus the original shipping charges. If you purchased something and the price drops after the purchase, we are not able to offer a refund on the difference.

Items that were purchased on sale or during any of our shopping events are not refundable. Gift cards are also not refundable. Due to the hand-made and made to order nature of our tables, we are also not able to accept exchanges or returns on these products.
Despite that we work hard to process your order as carefully as possible, an article can somehow get damaged. If the outside of the packaging appears to be damaged due to transportation, it is very important to notify the delivery company when you receive the parcel, or to refuse accepting the parcel. If you notify us within 14 days of receiving your parcel, we will replace the damaged or defect items at no extra charge.
Certain items we sell are fully made by hand. Consequently, size and color variations may occur. In addition, due to the used materials, the appearance of certain products may have certain imperfections (as listed on the Site as well). These imperfections are not considered as damages which are refundable as we are of the opinion that our customers should appreciate the beauty of hand made products by local artisans, which are by their nature imperfect, impermanent, and incomplete.
All complaints regarding damages, defects or delays in delivery should be communicated to us via info@ateliermliving.be.
Please add pictures in case of damaged goods.
8. Personal data
Atelier M Living uses your personal data for internal marketing use only, i.e. for sending you newsletters. Your personal data will not be forwarded or sold for marketing purposes to any third party.
9. Liability
Disputes are to be solved in mutual consultation wherever possible. Belgian law is applicable to the terms and conditions. Atelier M Living cannot be held responsible for mistakes, defects or loss of income by using this Site.
